Connecticut Medical Malpractice laws that limit lawsuits

Medical Malpractice

Medical Malpractice is the area of law that deals with negligence by doctors, nurses, and other health care providers. Medical Malpractice lawyers are concerned with recovering money for the victims of health care providres who stray from the standard of care, that is to say, who act negligently and injure their patient.

Some examples of Medical Malpractice include:

  • Failing to diagnose a disease, cancer, or condition;

  • Failing to properly perform a surgery or treatment;

  • Failing to remove surgical instruments at the conclusion of surgery;

  • Failing to properly follow up with appropriate medical care;

  • Failing to obtain the informed consent;

Hartford Legal Group will provide a free consultation to discuss your medical malpractice case.

Frivilous
Medical Malpractice Cases are EXPENSIVE for lawyers

When I meet new people out and about in the Hartford and West Hartford one of the first questions that is inevitably asked of me is "What do you do for a living?"

I answer that: "I am a civil lawyer. I handle personal injury cases, car accidents, dog bites, and medical malpractice cases....." and then almost always I am innocently interrupted. Either verbally, or by body language, or in some other subconscious way the person reacts to those infamous words:

MEDICAL MALPRACTICE.

Medical Malpractice law has a bad reputation. The reason it has a bad reputation is because  the general public sees medical malpractice law almost exclusively through the lens of the media, where the larger the verdict or settlement, the bigger the story is.

Medical Malpractice is blamed for straining our health care system, inflating health insurance premiums, and padding the pockets of lawyers at the public's expense.

But Medical Malpractice law does not deserve its maligned reputation. Doctors make errors and when they do people can get seriously hurt. Medical Malpractice lawsuits are often the only way possible for a victim to recover for or from their injuries.

So what about frivilous medical malpractice cases?" you may ask,
"Aren't those tolling our health care system and insurance premiums?"

The short answer is no. The simple fact is that Medical Malpractice lawsuits are very expensive for a lawfirm to bring especially in Connecticut where Connecticut law requires an expert in a similar medical speciality as the negligent party to support the lawsuit before it can even be filed.

In fact, because Medical Malpractice cases are so expensive, there is no other type of case that Hartford Legal Group must turn down more often. Some of the cases we cannot help with  include instances where both the fault of the health care provider and the injury to the patient are obvious.

We cannot afford to bring frivilous medical malpractice claims as they would lose us money and tarnish our reptuation. I think it's safe to say that other Connecticut Medical Malpractice lawyers feel the same way.

If a lawyer won't take a case, then the case will usually just die out.

Thus frivilous medical malpractice cases are a rarity!

Most of the time, the only way that it can be determined whether or not you have a medical malpractice case is by consulting with a medical malpractice lawyer.

We at Hartford Legal Group would be happy to sit down with you and discuss your case one on one to help determine whether or not you have a remedy available.
